§ 13-61. License—Required, carrying.

  • (a)

    It shall be unlawful for any person to go from house to house or from place to place in the city soliciting, selling or taking orders for or offering to sell or take orders for any goods, wares, merchandise, services, photographs, newspapers, magazines, books or subscription to newspapers, magazines or books without having first applied for and obtained a license to do so from the city manager or his designee. It shall also be unlawful to sell or solicit in the city as aforesaid without carrying such license while engaged in such soliciting or selling.

    (b)

    A license issued under the authority of this article constitutes a purely personal privilege which may not be sold, assigned or otherwise transferred and shall not inure to the benefit of a person other than the original licensee.

    (c)

    Notwithstanding the issuance of a license hereunder, no itinerant vendor shall sell goods in an area or zoning district or upon premises where such activity is prohibited or restricted or in violation of any law or ordinance otherwise prohibiting, restricting or regulating such activity.

    (d)

    A license issued under this article shall be prominently displayed in a conspicuous place so that the same may be easily read at any time during the sale, offer, exhibition or solicitation of orders for the sale of goods.

    (e)

    It shall be unlawful for an itinerant vendor or any employee, agent or representative of such itinerant vendor to sell goods in the city without prominently and conspicuously displaying his itinerant vendor's license as required in the preceding subpart.

    (f)

    It shall be unlawful for any person to present, display or to sell goods within the city under the authority of an itinerant vendor's license issued to another.

    (g)

    It shall be unlawful for any itinerant vendor to fail or refuse to display or exhibit his itinerant vendor's license or other identification upon the request by any member of the Athens police department or other law enforcement officer.

    (h)

    It shall be unlawful for any itinerant vendor to sell goods under the authority of any false, counterfeit, invalid or altered itinerant vendor's license.
