§ 16-39. Same—Violations.

In case of the failure of a railroad company to comply with the requirements of sections 16-37 and 16-38 for thirty (30) days after written notice given to the section foreman of the section where such work or repairs are needed, by the city engineer, it shall be liable to a penalty of ten dollars ($10.00) for each week such railroad company may fail or neglect to comply with such requirements, recoverable in any court having jurisdiction of the amount involved in a suit in the name of the city.
